1. Overview
These Terms of Service ("Terms") govern access to and use of Macabre Magazine™, including its website at cms.macabremagazine.com/, its digital archives, its social media presences, and any affiliated platforms or publications (collectively, the "Publication"). Macabre Magazine™ is published by Dark Harbor Press LLC, a subsidiary of Blakemore Enterprises LLC. Macabre Magazine is a trademark of Blakemore Enterprises LLC.
By accessing the Publication, submitting work, or otherwise engaging with Macabre Magazine™ in any capacity, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
2. Definitions
“Publication” refers to Macabre Magazine™ in all its forms, including its website, digital archives, social media channels, audio platforms, video channels, print editions, anthologies, and any affiliated or successor platforms.
“Contributor” refers to any individual who submits, and whose work is accepted for publication by, Macabre Magazine™.
“Reader” refers to any individual who accesses, browses, or consumes content through the Publication by any means.
“Content” refers to all written works, audio recordings, visual art, photography, short films, video submissions, and any other creative or editorial material published or displayed through the Publication.
“Editorial Team” refers to the editors, managing staff, and editorial leadership of Macabre Magazine™ acting under the authority of Dark Harbor Press LLC.
“We,” “Us,” “Our” refers to Dark Harbor Press LLC, publisher of Macabre Magazine™.
3. Terms for Contributors
3.1 Submission
By submitting work to Macabre Magazine™, a Contributor represents and warrants that:
- The submitted work is their original creation;
- They hold full rights to submit the work and to grant the rights described herein;
- The work does not infringe upon the intellectual property, privacy, or other rights of any third party;
- The work has not been previously published in a form that would conflict with the rights granted herein, unless expressly disclosed at the time of submission and approved in writing by the Editorial Team;
- All factual claims contained in nonfiction submissions are, to the best of the Contributor’s knowledge, accurate.
Submission does not constitute acceptance. Macabre Magazine™ reserves the right to accept or decline any submission at its sole editorial discretion, with or without explanation.
3.2 Rights Granted Upon Acceptance
Upon acceptance of a work for publication, the Contributor grants Dark Harbor Press LLC the following rights:
Exclusive First Serial Rights. Exclusive publication rights for six (6) months in English following the work’s release date. During this exclusivity period, the work may not appear elsewhere in print or online without prior written approval from the Editorial Team. Exceptions may be granted at the Editorial Team’s discretion upon advance written notice from the Contributor for approved reprints or special features, provided that any such subsequent publication includes the acknowledgment: “Originally published in Macabre Magazine.”
Archival Rights. Non-exclusive, perpetual rights to display and preserve the work in Macabre Magazine’s digital archives, anthologies, or affiliated platforms.
Promotional Rights. Perpetual rights to reproduce excerpts, stills, or short clips from the work for marketing, publicity, and review purposes in service of promoting both the Contributor and the Publication.
Syndication and Reprint Rights. Following the conclusion of the six-month exclusivity period, Macabre Magazine™ reserves the right to feature selected works or excerpts in curated “Best Of” editions or to offer reprints to recognized horror-genre outlets — including but not limited to Rue Morgue, Daily Dead, and Horror DNA — with full Contributor credit and clear acknowledgment of Macabre Magazine™ as the original publisher.
Anthology Rights. Non-exclusive right to republish accepted works in future anthologies, special editions, or collected volumes, with full Contributor credit.
Audio Rights. Non-exclusive right to produce, publish, and distribute narrated or audio-adapted versions of accepted works on Macabre Magazine’s official media platforms.
Audio-Visual Rights. Non-exclusive right to adapt or incorporate accepted works within multimedia presentations, promotional videos, or editorial showcases. The Contributor retains all film, television, dramatic, and theatrical rights.
Video and Short Film Rights. Non-exclusive, perpetual archival and exhibition rights to host, stream, and maintain accepted short films or video submissions on Macabre Magazine’s official websites and official distribution channels, including use of stills or excerpts for promotional or editorial purposes. All other commercial and distribution rights remain with the Contributor.
Award and Nomination Rights. Right to nominate accepted works — written, audio, or film — for professional or genre-recognized awards, prizes, or external anthologies, including but not limited to the Pushcart Prize, Best of the Net, the Bram Stoker Awards, and recognized film festivals such as the Horrible Imaginings Film Festival, Panic Fest, and the Nightmares Film Festival. All nominations will be made in the Contributor’s name, with full credit to Macabre Magazine™ as the original publisher or exhibitor.
3.3 Reservation of Rights
All rights not expressly granted herein are reserved by the Contributor. All other rights revert to the Contributor six (6) months after the work’s publication date. Copyright in the work remains with the Contributor at all times. Macabre Magazine™ and Dark Harbor Press LLC claim no ownership interest in any submitted work beyond the rights expressly enumerated in Section 3.2.
3.4 Contributor Representations and Indemnification
Contributors agree to indemnify, defend, and hold harmless Dark Harbor Press LLC, Blakemore Enterprises LLC, and their respective officers, agents, and representatives from any claim, liability, loss, or expense — including reasonable attorneys’ fees — arising from any breach of the representations made in Section 3.1 or from any third-party claim relating to submitted Content.
3.5 Editorial Discretion
Macabre Magazine™ reserves the right to edit accepted works for style, length, clarity, and consistency with editorial standards, in consultation with the Contributor where material changes are involved. Publication dates are subject to editorial scheduling and are not guaranteed.
4. Terms for Readers
4.1 Access and Permitted Use
Macabre Magazine™ grants Readers a limited, non-exclusive, non-transferable license to access and view the Publication’s Content for personal, non-commercial use only. This license does not include the right to reproduce, distribute, publicly display, publicly perform, transmit, or create derivative works from any Content without prior written permission from Dark Harbor Press LLC.
4.2 Prohibited Conduct
Readers agree not to:
- Reproduce, copy, republish, or redistribute any Content from the Publication, in whole or in part, without prior written consent from Dark Harbor Press LLC;
- Scrape, crawl, or otherwise harvest Content from the Publication by automated means;
- Use any Content for commercial purposes without a separate written license from Dark Harbor Press LLC;
- Misrepresent Content from the Publication as their own work or remove attribution from any Content;
- Engage in any conduct that interferes with or disrupts the Publication’s website, servers, or infrastructure;
- Attempt to gain unauthorized access to any portion of the Publication or its systems.
4.3 Third-Party Links
The Publication may contain links to third-party websites or resources. Dark Harbor Press LLC is not responsible for the content, accuracy, or practices of any third-party sites and does not endorse them. Access to third-party sites is at the Reader’s own risk.
4.4 User-Generated Content
To the extent the Publication permits Readers to post comments, responses, or other user-generated content, Readers grant Dark Harbor Press LLC a non-exclusive, royalty-free, perpetual license to display and moderate such content. Readers are solely responsible for any content they post and agree not to submit content that is unlawful, defamatory, harassing, infringing, or otherwise objectionable. Dark Harbor Press LLC reserves the right to remove any user-generated content at its sole discretion.
5. Intellectual Property
All editorial content, design, branding, layout, and compilation of the Publication — exclusive of individually contributed works — is the property of Dark Harbor Press LLC. © 2024–2026 Dark Harbor Press LLC. All rights reserved. Macabre Magazine is a trademark of Blakemore Enterprises LLC. Unauthorized use of the Macabre Magazine name, mark, or trade dress is prohibited and may give rise to legal action.
6. Disclaimers
THE PUBLICATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. DARK HARBOR PRESS LLC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY CONTENT PUBLISHED HEREIN. VIEWS EXPRESSED BY CONTRIBUTORS ARE THEIR OWN AND DO NOT NECESSARILY REFLECT THE VIEWS OF DARK HARBOR PRESS LLC OR BLAKEMORE ENTERPRISES LLC.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DARK HARBOR PRESS LLC AND BLAKEMORE ENTERPRISES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE PUBLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
9. Modifications
Dark Harbor Press LLC reserves the right to modify these Terms at any time. Modifications will be effective upon posting to cms.macabremagazine.com/. Continued use of the Publication following the posting of revised Terms constitutes acceptance of those Terms. Readers and Contributors are encouraged to review these Terms periodically.
